Terms & Conditions — Wedding Photography

General

  1. The following terms and conditions apply to all wedding assignments given to the photographer, as well as her offers, services, and deliveries. By accepting the service, they are deemed accepted and agreed upon.
  2. “Images” in these terms refer to all products created by the photographer, regardless of technical form or medium (files, prints, videos, products, etc.).
  3. Any additional agreements are only valid if made in writing, and any differing terms of the client are only effective if confirmed in writing by the photographer.
  4. The contract (including verbal agreements) comes into effect once the service is used (e.g., a photoshoot is booked or image material is accepted).
  5. The client is aware of the photographer’s style. The photographer is therefore free in how the images are created and edited.

Copyright

  1. The photographer holds the copyright to all images according to German copyright law. Publication of the images is agreed upon with the client in advance.
  2. Images produced by the photographer are intended for private use only. Transfer to third parties is not permitted without the photographer’s consent (except for guests, friends, or relatives for private use). “Third parties” include service providers like stylists or bridal shops. These may contact the photographer directly to obtain permission for using the images.
  3. If usage rights are granted by the photographer, unless otherwise agreed in writing, only a simple usage right is transferred. Any further transfer of usage rights requires a separate written agreement.
  4. Commercial or promotional use of images requires payment and a separate agreement with the photographer.
  5. When publishing images, the photographer has the right to be credited (e.g., Photo: Oxana Becker).
  6. RAW files remain the property of the photographer and will not be handed over to the client.

Payment / Retention of Title

  1. Fees for images are calculated per hour, day, or agreed package. Additional costs (e.g., travel) are borne by the client and agreed upon in writing in advance.
  2. Any additional hours requested by the client will be charged accordingly. The photographer will inform the client before calculation, and the charge begins upon the client’s verbal confirmation.
  3. Invoices are payable within 7 days without deduction.
  4. A deposit of 30% of the total fee is required to reserve the date. The remaining 70% is due on the day of the shoot, but no later than 7 days after, payable by bank transfer or cash. The client agrees to receive invoices via email or WhatsApp; in this case, postal delivery is omitted. Until full payment is received, images remain the property of the photographer.
  5. Complaints or editing requests must be submitted in writing within 3 days after delivery of the images.
    a) Implementation of changes is at the photographer’s discretion.
    b) Changes may only concern color, contrast, brightness, sharpness, and image cropping.
    c) Photomanipulations such as removing/inserting objects or people, altering faces or figures, or changing backgrounds are excluded.
Note: The client is responsible for their own appearance (makeup, clothing, etc.) on the day of the shoot. The photographer is not responsible for ensuring the client’s appearance.After requested changes are implemented, the final images are considered delivered and accepted. Any further changes require a new agreement and additional charges.

Image Delivery

  1. Images are delivered digitally (JPG) in the highest available resolution via an online gallery or download link.
  2. Optional delivery by post via USB stick, photo box, or photo book, if booked or included in the package.

Breaks & Meals

To maintain the photographer’s productivity and performance:
  1. For wedding coverage of 6 hours or more, the photographer is entitled to a 30-minute break, scheduled at a convenient moment (e.g., during guest meals). The photographer will remain nearby to avoid missing special moments.
  2. Drinks (water/soft drinks) for guests should be available and considered for the photographer.
  3. For weddings longer than 6 hours, the photographer should be included in one meal with a seat provided.
  4. Travel time between locations counts as working time, not breaks.

Cancellation Policy

  1. If the wedding cannot take place due to force majeure (e.g., illness, natural disaster), the photographer will not demand further payment. The deposit will be retained to cover expenses already incurred. The photographer will attempt to reschedule.
  2. For cancellations by the client for other personal reasons, the deposit is non-refundable. It covers costs such as reserving the date, pre-shoot consultations, and administrative work.
  3. If the photographer cannot perform the service due to force majeure, the couple cannot claim damages or additional costs. In the unlikely event of total cancellation, all payments made will be refunded. The photographer will try to provide a replacement photographer but cannot guarantee it.
